Beastgame Reality Casting Terms of Use
These Terms of Use apply to your access and use of this website, including all content, features, activities, and services (collectively, the "Experience"). This Experience is managed and provided by Beastgame Worldwide Entertainment, LLC and/or our affiliated companies (collectively, "Beastgame"), including our agents and contractors ("Experience Providers"). By accessing and using this Experience, you agree to be bound by these Terms of Use.
Usage Rights. You must be at least 21 years old to use this Experience. Access and use of this Experience is for personal and non-commercial purposes only. Beastgame grants you a limited, non-transferable, royalty-free right to access and use this Experience, provided that you comply with the following conditions: (i) you comply with all applicable laws, rules, and regulations; (ii) you do not store, download (except for caching required for personal use), reproduce, distribute, modify, display, publicly perform, publish, license, create derivative works from, or sell any content and information from this Experience or otherwise obtained through this Experience without the express written permission of Beastgame and its licensors; (iii) you do not circumvent, remove, alter, disable, degrade, or interfere with any content protection measures of this Experience; (iv) you do not use any robots, spiders, scrapers, or other automated means to access this Experience; (v) you do not reverse engineer, disassemble, or decompile any software or other products or processes accessible through this Experience; (vi) you do not insert any code or products or manipulate the content of this Experience in any way, or use any data mining, data gathering, or data extraction methods; and (vii) you do not upload, post, email, or otherwise transmit or convey any data intended to disrupt, damage, or limit the functionality of any computer software, hardware, or telecommunications equipment associated with this Experience, including any software viruses or any other computer code, files, or programs. Except for the limited license above, we do not transfer any rights, title, or interest to you.
Security and Experience Access. When accessing or using this Experience, you agree not to use any means that could harm, overload, or damage any accounts, computer systems, or networks. You agree not to attempt to gain unauthorized access to this Experience or any part of any accounts, computer systems, or networks. Password-protected or secure areas of this Experience are for access and use by authorized users only. Each user must have a separate username and password, and you agree not to share your password, account information, or access to this Experience with anyone. You have a duty to keep your password and account information confidential; you are responsible for all activities that occur through the use of your password or account or through your access to this Experience. If your password or account is used without your authorization or the authorization of these Terms of Use, you agree to immediately notify Beastgame.
Rights Reserved. Beastgame and its licensors exclusively own all rights, title, and interest in this Experience, including all related intellectual property rights. You acknowledge that this Experience is protected by U.S. and other countries' copyright, trademark, and other laws. You agree that you will not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices contained in or accompanying this Experience. If you believe that your work has been reproduced or distributed in a way that infringes your copyright, or if you notice any content provided by this Experience that you suspect infringes copyright, please notify us by completing the "Copyright Infringement Complaint Form" (www.Beastgame.com/copyrights).
User Generated Content.You may express your interest in potentially appearing on Beastgame reality shows through this Experience, including by transmitting, uploading, or otherwise providing text, images, audio, video, or other content (referred to as "User Generated Content"). Submission of User Generated Content is limited to this purpose and may not be used to submit creative concepts or proposals. By submitting User Generated Content through this Experience, you represent that:
All participants appearing in the User Generated Content are at least 18 years old;
You have all rights, title, and authority to submit User Generated Content through this Experience, including (where applicable and without limitation) the informed consent of any third parties who appear in or have an interest in the User Generated Content.
You agree that the User Generated Content constitutes a "work made for hire" and that Beastgame (or its affiliated companies) shall exclusively own the User Generated Content. If the User Generated Content does not qualify as a work made for hire, to the maximum extent permitted by applicable law, you assign all rights (including copyright) in the User Generated Content to Beastgame and its affiliated companies. If you have moral rights in the User Generated Content, to the extent permitted by applicable law, you hereby agree to waive all moral rights in the User Generated Content. If the moral rights in the User Generated Content cannot be waived, you agree not to exercise the moral rights in the User Generated Content to the maximum extent permitted by applicable law.
You agree that Beastgame and its Experience Providers may modify, adapt, publish, reproduce, display, distribute, create derivative works from, publicly communicate the User Generated Content, or otherwise use the User Generated Content in any manner that Beastgame and its Experience Providers deem appropriate;
The User Generated Content complies with applicable laws and regulations and does not contain any obscene, defamatory, discriminatory, threatening, pornographic, libelous, harassing, hateful, racially or ethnically offensive content, or encourages conduct that could be considered criminal;
If any third party makes a claim against Beastgame, its affiliated companies, agents, and Experience Providers regarding the User Generated Content's infringement of any third party's rights, you agree to indemnify Beastgame, its affiliated companies, agents, and Experience Providers;
You understand that you will not receive compensation for the User Generated Content;
You agree to waive all of your publicity rights (to the extent permitted by applicable law) and have asked for and obtained the consent of all third parties (if any) to use third parties' likeness/appearance in the User Generated Content; and
You agree to execute all such assignments or other documents and take any actions that Beastgame or its Experience Providers may require to achieve ownership or otherwise effectuate the rights referred to in this section.
You understand that Beastgame and/or its affiliated companies may currently possess or may receive or develop in the future materials that are similar to your User Generated Content or contain the same elements. Beastgame's rights to use such materials are unrestricted, and Beastgame has no obligation to you, and you have no right to object to Beastgame's use of these materials. If you do not agree, please do not upload User Generated Content.
If you submit User Generated Content through this Experience and provide your email address and other details, you consent to receive emails from Beastgame and its affiliated companies regarding your user submissions and/or casting opportunities. You can unsubscribe from such emails at any time by clicking the "unsubscribe" link in the footer, or by emailing unsubscribe@Beastgamereality.com to request unsubscription from these emails.
Name and Likeness.By using this Experience, you grant Beastgame and our respective successors, assignees, and any other licensees an irrevocable, perpetual, worldwide, and non-exclusive right to record, depict, and/or describe you, and agree that others have the right (but not the obligation) to record, depict, and/or describe you, and to use your actual or simulated likeness, name, photograph, voice, or performance in: your User Generated Content and/or content related to this Experience; all development, production, distribution, exploitation, advertising, promotion, and publicity related to Beastgame services, content, and/or this Experience, in any media (including currently known and future media), and in all languages, formats, versions, and forms related to this Experience. No compensation will be provided to you or any other individual unless prohibited by law.
Waiver of Claims.You hereby waive any claims of any type against Beastgame, its affiliated companies, employees, agents, Experience Providers, and any of their representatives arising from or related to the use of User Generated Content, whether known or unknown. You will never make any claim or demand against Beastgame, nor will you take any action regarding any use or alleged use related to User Generated Content, and you expressly waive any right to make such claims. You acknowledge that there may be facts related to or directly connected with these Terms of Use that you do not know or suspect exist, and therefore you hereby waive any claims arising from or related to such facts.
Privacy.Please refer to our Beastgame Reality Casting Privacy Statement to understand how we collect, use, disclose, and protect your information.
Confidentiality.This Experience may contain Confidential Information of Beastgame and other parties (referred to as "Confidential Information"). Confidential Information includes all non-public information that can be obtained through this Experience. You agree to protect all Confidential Information and agree to use the same degree of care in protecting such Confidential Information as you use to protect your own Confidential Information from unauthorized use, disclosure, or publication, and such degree of care shall not be less than reasonable care.
Changes.We may update these Terms of Use at any time and may change or terminate all or part of this Experience at any time. We may also suspend or terminate your access to this Experience at any time without notice to you. If you continue to use this Experience after the updated Terms of Use are published, you agree to be bound by the updated Terms of Use. You may cancel your account at any time; to cancel, you may send us an email through the support function of this Experience. Even if this Experience or your account is terminated, deactivated, or cancelled, the sections of these Terms of Use regarding "Rights Reserved," "User Generated Content," "Confidentiality," "Warranties and Liability," and "General" will continue to remain in effect.
Warranties and Liability.This Experience provides no warranties. Beastgame and its affiliated business entities, Experience Providers, or any other party involved in creating, producing, or providing the Experience shall not be liable for any direct, incidental, consequential, indirect, or punitive damages or losses arising from your access to or use of this Experience, even if such losses have been previously disclosed. This limitation applies even if Beastgame has been informed or should have known of the possibility of such damages. Some jurisdictions do not allow certain exclusions or limitations. In such jurisdictions, the exclusions and limitations described in these Terms of Use shall apply to you to the maximum extent permitted by law. If there is any dispute regarding these Terms of Use or their subject matter, your sole remedy is to seek the damages specified in this section, and you have no right to seek injunctive or other equitable relief.
Third Party Websites.This Experience may contain links to other websites owned and operated by third parties (referred to as "Third Party Websites"). We provide these links for your convenience, and you must visit any Third Party Websites at your own risk. Beastgame is not responsible for the content on these Third Party Websites and makes no representations or warranties regarding such content. Access to and use of any such Third Party Websites is subject to their terms of use and privacy policies.
General.You may not assign all or part of the rights granted by these Terms of Use without the express written consent of Beastgame, whether by contract, law, or otherwise. These Terms shall be governed by and interpreted in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. If any provision of these Terms of Use is deemed partially or completely illegal or unenforceable, that provision shall be enforced to the maximum extent permitted, and the other provisions of these Terms of Use shall continue to remain in full legal force and effect. Waiver of any breach or non-performance under these Terms of Use shall not constitute a waiver of any other subsequent breach or non-performance. These Terms of Use represent the complete and exclusive agreement between you and Beastgame regarding this Experience and supersede any prior or contemporaneous oral or written communications between you and Beastgame related to this Experience.
